These Terms & Conditions (the "Terms") govern your use of chalesend.com and any pages that link to these Terms (the "Website"), operated by ChaleSend, Inc. ("ChaleSend," "we," "us," or "our"). By using the Website, you agree to these Terms. If you do not agree, please do not use the Website.
1. About ChaleSend
ChaleSend provides cross-border money transfer services for people sending money from the United States to family, friends, and businesses abroad. The Website gives information about our services and lets you join our waitlist or contact us. Information about our registration and regulatory compliance is on our Licensing & Compliance page.
2. Our services and the ChaleSend app
Money transfers and related features, including wallets, delivery options, and the optional micro-savings and investment add-on, are provided through the ChaleSend app. They are governed by the separate user agreement and policies you accept when you open an account. If those terms conflict with these Terms, the app terms control for those services. Features, supported countries, delivery methods, and delivery times may vary and may change over time.
3. Eligibility and verification
You must be at least 18 years old and able to form a binding contract to use our services. Opening an account and sending money requires identity verification and compliance checks, including know-your-customer (KYC) and anti-money-laundering (AML) review. We may decline, delay, or cancel an account or transaction when needed to comply with the law or to protect you, your recipients, or ChaleSend.
4. Waitlist and communications
Joining the waitlist does not open an account. It also does not guarantee access, pricing, or particular features. We use the information you give us to send launch updates and early-access offers, as described in our Privacy Policy. You can ask us to stop at any time by emailing support@chalesend.com.
5. Exchange rates, fees, and examples
Exchange rates, fees, delivery times, and examples shown on the Website, including any rate calculator, are for information only. They can change without notice and are not an offer. The exchange rate, fees, and amount your recipient will receive are shown in the app before you confirm a transfer. See also our Disclaimer.
6. Acceptable use
You agree not to use the Website or our services:
- for any unlawful purpose, including fraud, money laundering, terrorist financing, or evading sanctions;
- to give false or misleading information, or to act on behalf of someone else without their permission;
- to interfere with the Website's security or operation, including introducing malware or attempting unauthorized access; or
- to copy, scrape, or reuse Website content in bulk without our written permission.
7. Intellectual property
The ChaleSend name, logo, and the Website's content, design, and graphics belong to ChaleSend or its licensors and are protected by law. You may view and share Website pages for personal, non-commercial purposes. Any other use requires our written permission.
8. Third-party links and services
The Website may link to third-party sites and services, such as app stores and social media. We do not control them and are not responsible for their content, policies, or practices. Your use of them is governed by their own terms.
9. Disclaimers
The Website is provided "as is" and "as available." To the fullest extent permitted by law, ChaleSend makes no warranties of any kind about the Website, including warranties of accuracy, availability, merchantability, or fitness for a particular purpose. Nothing on the Website is financial, investment, legal, or tax advice.
10. Limitation of liability
To the fullest extent permitted by law, ChaleSend and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the Website. This section does not limit any rights you have under laws that cannot be waived, including laws that protect consumers who send money transfers.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will change the "Last updated" date above. Continuing to use the Website after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of the State of Delaware and applicable U.S. federal law, without regard to conflict-of-law rules.
